The Supreme Court will hear arguments Wednesday about which environmental requirements the government must follow when handling unexploded WWII-era munitions in Guam. For decades, the government has brought the munitions to Anderson Air Force Base. It agrees it must follow the Resource Conservation and Recovery Act (RCRA), which lays out procedures specifically for hazardous waste. But the U.S. Air Force (USAF) faces a lawsuit insisting it must also adhere to the mandates of the National Environmental Policy Act (NEPA), a more generic statute that requires federal agencies to assess environmental impacts before major projects.
