The U.S. Court of Appeals for the Third Circuit handed down a 2-1 decision keeping alive two of three federal counts against McIver, who faces charges of assaulting and impeding federal immigration officers during a chaotic May 2025 confrontation at the Delaney Hall ICE detention center in Newark, New Jersey. Alice Stilwell Holt, 67, and Robert Barr Jr., 54, both of Egg Harbor Township, New Jersey, were driving their Hyundai sedan near Route 50 and Third Street in Mays Landing on the morning of August 22 when a stolen 2024 Mercedes-Benz G Wagon, traveling on the wrong side of the road, struck them head-on.
