What did the Biden White House memo acknowledge regarding previous litigation against Trump's TPS terminations?
The memo acknowledged that previous litigation successfully halted Trump's efforts to terminate TPS for nations like Sudan, Nicaragua, Haiti, El Salvador, Nepal, and Honduras, but conceded this was largely due to the administration's failure to produce a factual record to support termination, a weakness that could be rectified.

How did Sen. Eric Schmitt characterize the Biden administration's attempt to expand TPS?
Sen. Eric Schmitt, a Missouri Republican, called the plan "mass amnesty-by-decree" and a deliberate attempt to subvert the will of the American people and the 2024 election results. He further alleged that the expansion would have shielded members of Tren de Aragua, a Venezuelan gang, though the memo itself did not specifically name the gang.

What was the purpose of the January 2025 Biden White House memo regarding Temporary Protected Status (TPS)?
The memo, obtained by Sen. Eric Schmitt, outlined plans to expand TPS to more than 3 million noncitizens as a "last-ditch effort" to block President Trump's deportation agenda before he took office. The document's own language stated the goal was to "protect many vulnerable people from President-elect Trump's planned mass deportations" and noted that advocates were prepared to litigate to slow down or terminate the TPS implementation.
