DHS claims that Garcés Pérez faced a final order of removal from the country. His lawyer says that he originally entered the country seeking asylum and had gotten a work permit. His attorney says that Garcés Pérez changed his address in immigration court, but that a hearing notice was sent to his previous address, so he was unaware and didn't go, which led to a removal order.
