Dr. Fauci is facing pressure from three state attorneys general who have subpoenaed him over allegations concerning personal profit from COVID guidance.

Senator Rand Paul, the Kentucky Republican who chairs the Homeland Security Committee, argues that Fauci's repeated Fifth Amendment claims are improper because President Joe Biden issued a preemptive pardon to the former health official. Paul contends that because a pardon removes the threat of criminal prosecution, the constitutional basis for refusing to answer via the protection against self-incrimination evaporates.

Dr. Fauci invoked the Fifth Amendment right against self-incrimination 100 times during the July 29 hearing.
