The position was presented in a brief filed Friday by Solicitor General D. John Sauer in two cases before the Supreme Court: Viramontes v. Cook County and Grant v. Higgins.
In its next term, the Supreme Court will hear a major consolidated case on assault weapon bans and whether the Second Amendment protects the right to possess AR-15s and semiautomatic rifles.
