A West Virginia couple represented by Alliance Defending Freedom has petitioned the Supreme Court to review a federal appeals court ruling that forces their daughter to receive vaccinations to attend a fully virtual school, a mandate the family says violates their religious beliefs and ignores recent high court precedent. Krystle and Anthony Perry want their daughter enrolled in the West Virginia Virtual Academy, where every lesson takes place at home. West Virginia requires students at the academy to be "fully vaccinated" as a condition of attendance. More than 53,000 New York children are now homeschooled, triple the number from 15 years ago, as parents abandon a public system where most students in hundreds of schools can't pass basic math or reading exams. New York State recorded 53,905 homeschooled children in the 2025, 2026 school year, a figure that has more than tripled since 2009, 2010 and represents what state data show is the fastest-growing school sector in New York. In New York City alone, more than 14,000 children now learn at kitchen tables, in museums, and in parks instead of public school classrooms.
